As a condition for use of the service, the user consents, agrees and permits Toktokwallet, including its subsidiaries, affiliates, lawyers, consultants and authorized subcontractors to process or disclose personal data, including data that may be classified as personal information and/or sensitive personal information under the Data Privacy Act of 2012 to Toktokwallet’s employees, agents, affiliates, lawyers, subsidiaries, and third party in order to conduct activities, such as, but not limited to:
i.) processing and conducting analysis for research purposes
ii.) provision of customer care
iii.) showing of relevant ads based on the user’s preference
iv.) conduct of statistical analysis based on the user’s usage and preference
Other than as described in these T&Cs, we shall secure and shall not disclose any of your information, unless your expressed permission is given.
The Toktokwallet application and site use forms in which you give us contact information (including your name, address, telephone number, and email address) so you can use the application, request information and support, and make product suggestions. For certain services, we may also request a government identification number, or other financial information. We shall then create an account for you.
We shall receive and store any information you enter on our mobile application or give us in any other way, including through email, telephone, or other communications with our customer service department. For future reference, we shall keep an internal record of support we provide to users. We shall use your information to contact you regarding functionality changes to our products, services, and special offers we think you find valuable.
Toktokwallet shall maintain and keep the user’s information with due diligence and strict confidence.
You hereby consent to and authorize Toktokwallet, for the purpose of conducting its operations, including but not limited to fraud and risk management, sales and marketing activities, communications relating to its products and/or services, product and system development and innovation, customer experience management and improvement, and market research, to collect and process any and all information related thereto from whatever relevant source.
You hereby consent to and authorize the disclosure of and release by Toktokwallet, of any and all information required by Toktokwallet such as, but not limited to, the following [i] voice calling data records; [ii] Email and/or SMS sending and receiving records; [iii] Data usage records; [iv] Promo subscription and redemption records; [v] Customer relationship management records; Credit information; [viii] KYC data; [ix] Registration data; and [x] Transaction data.
The foregoing consents and authorizations shall continue for the duration of, and shall survive the termination of, this Agreement, or any other transactions, dealings, arrangements and accounts which you may have with, or avail from Toktokwallet, Inc.
The mobile application and website have security measures in place to protect account holders against the loss, misuse or alteration of the information under our control.
Toktokwallet may use the user’s name or mark and identify the customer as our client, on our website and/or marketing materials. Toktokwallet may issue a press release, containing the customer’s name, related to any award under this Agreement. Neither party will use the other party’s name or marks, refer to or identify the other party for any other reason, except as established in this section, without such other party’s written approval. Any approval required under this section shall not be unreasonably withheld or delayed by either party.
These Terms and Conditions shall be governed by the law of the Philippines.
Venue of all suits shall be exclusively in Taguig City, to the exclusion of any other Courts.
No course of dealing, nor any failure to exercise, nor any delay in exercising any right, power or privilege hereunder shall operate as a waiver thereof, unless it is in writing signed by the Party granting the waiver.
The invalidity or unenforceability, in whole or in part, of any provision in this Agreement shall not affect in any way the remainder of the provisions herein.
These T&Cs may only be released, discharged, supplemented, interpreted, amended, varied or modified by an instrument in writing signed by a duly authorized officer or representative of each of the parties.
These T&Cs constitute the entire agreement between the parties as to the use of Toktokwallet, and supersede and extinguish all previous drafts, agreements, arrangements, and understandings between the parties, whether written or oral relating to the use of Toktokwallet.
Furthermore, the user agrees to be bound by these Terms and Conditions governing the use of the Toktokwallet.
